Terms of Service

1. Acceptance of Terms

By accessing or using Nitrogen Tracker (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the Service.

If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Who We Are

Nitrogen Tracker (also referred to as "we", "us", or "our") provides a web-based tool intended to help users organise farm records and generate indicative summaries based on user-entered data. Contact: jliudoyle@nitrogentracker.com.

3. Description of the Service

The Service allows you to input and manage farm-related data (for example, livestock numbers, land areas, fertiliser and slurry inputs) and generate indicative calculations and reports for planning and record-keeping.

• Record and organise farm data for your own use
• Generate indicative nitrogen and phosphorus summaries based on your inputs
• Create exports and reports for your own records
• View trends, reminders, and planning indicators

4. Eligibility

You must be legally capable of entering into a binding contract to use the Service. If you are using the Service for business purposes, you confirm you have authority to do so.

5. User Accounts

• You must provide accurate and up-to-date account information.
• You are responsible for maintaining the confidentiality of your credentials.
• You are responsible for all activity under your account.
• You must notify us promptly of any unauthorised use or security incident.

6. Your Responsibilities

You agree that you are solely responsible for:

• The accuracy, completeness, and legality of all data you enter.
• Maintaining your own backups and records as required by law or by your advisors.
• Independently verifying any outputs, calculations, and reports.
• All compliance decisions, submissions, and communications with authorities.

7. Acceptable Use

You agree not to:

• Use the Service for unlawful, harmful, or fraudulent purposes.
• Attempt to gain unauthorised access to accounts, systems, or data.
• Interfere with or disrupt the Service, servers, or networks.
• Upload malware, exploit code, or attempt to reverse engineer the Service.
• Scrape, copy, or reproduce content or outputs at scale without permission.
• Share credentials or allow unauthorised persons to access your account.

8. Your Data and Content

You retain ownership of the data you submit to the Service ("User Data"). You grant us a limited, non-exclusive licence to host, process, transmit, and display User Data solely to provide and improve the Service (for example, generating reports you request and maintaining backups).

We do not sell your User Data. Our handling of personal data is described in our Privacy Policy.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you acknowledge you have read and understood it.

10. Third-Party Services

The Service may rely on third-party providers for hosting, authentication, analytics, or infrastructure. Those providers process data under their own terms and policies.

• Vercel — hosting and deployment

We are not responsible for third-party outages, interruptions, or failures outside our reasonable control.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

• The Service may contain errors, inaccuracies, or delays.
• Outputs depend on your inputs and may be incomplete or incorrect.
• We do not guarantee that the Service will be uninterrupted, secure, or error-free.
• We do not guarantee any outcome, regulatory status, or compliance result.

12. No Regulatory Duty or Update Obligation

References within the Service to guidelines, limits, or regulatory frameworks are provided for convenience only and may become outdated. We may update logic or references from time to time, but we do not undertake any duty to monitor, interpret, or notify you of changes in laws, regulations, guidance, or enforcement practices.

You are responsible for confirming current requirements with official sources and/or your advisors.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Nitrogen Tracker will not be liable for any indirect, incidental, special, consequential, or economic losses arising out of or related to your use of, or reliance on, the Service.

This includes, without limitation, loss of profits, loss of business, loss of data, business interruption, or costs arising from compliance decisions or regulatory outcomes.

To the maximum extent permitted by law, Nitrogen Tracker’s total aggregate liability for any claim relating to the Service will not exceed:

• the total fees paid by you to Nitrogen Tracker in the three (3) months immediately preceding the event giving rise to the claim; or
• if no fees have been paid, fifty euro (€50),

whichever amount is greater.

14. Indemnity

You agree to indemnify and hold harmless Nitrogen Tracker and its operators from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service, (b) your User Data, (c) your breach of these Terms, or (d) your violation of any law or regulation (including any regulatory penalties or enforcement actions).

15. Suspension and Termination

We may suspend or terminate access to the Service (in whole or in part) at any time if we reasonably believe you have violated these Terms, posed a security risk, or misused the Service.

You may stop using the Service at any time. Where feasible, you may request account deletion in accordance with our Privacy Policy.

16. Service Changes

We may modify, suspend, or discontinue the Service (or any part of it) at any time, including features, functionality, and availability. We do not guarantee that any feature will remain available indefinitely.

17. Fees (If Applicable)

Some features may be offered for a fee now or in the future. If paid plans are introduced, pricing and billing terms will be presented at the point of purchase. Unless required by law, fees are non-refundable.

18. Intellectual Property

The Service, including its software, design, text, graphics, logos, and other content (excluding User Data), is owned by Nitrogen Tracker or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written permission.

19. Force Majeure

We will not be liable for any failure or delay in performance to the extent caused by events beyond our reasonable control, including acts of God, natural disasters, power or internet outages, strikes, epidemics, war, terrorism, civil unrest, or failures of third-party hosting or infrastructure providers.

20. Governing Law

These Terms are governed by the laws of Ireland. Subject to applicable mandatory consumer protections, the courts of Ireland will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.

21. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
